Personal Data Processing

1. Data Controller

EIS Luxembourg S.à r.l. (hereinafter referred to as “EIS”) is responsible for processing the personal data collected via this website and in the course of its activities (“we”), in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Luxembourg legislation.

When EIS implements free upskilling actions co-financed by the European Social Fund Plus (ESF+), EIS acts as project bearer linked by a bilateral agreement to the Luxembourg Ministry of Labour.

In this specific context:

  • The Ministry of Labour is responsible for processing data collected for the purposes of operational monitoring, reporting and the production of statistical indicators for the European Commission.
  • EIS acts as a sub-processor, exclusively for the collection and transmission of data required by the ESF+ Managing Authority.
  • The transmitted data are then processed by the Ministry and used in pseudonymised or anonymised form for demographic statistics purposes.

2. Data Collected and Purposes

2.1 Via the Website

We collect strictly necessary data (first name, last name, email address, telephone number) in order to:

2.2 In the Context of ESF+ Co-financed Actions

In accordance with the obligations arising from Regulations (EU) 2021/1057 and 2021/1060, EIS is required to collect certain data relating to participants in co-financed actions.

These data may include:

  • Identification data (surname, first name, contact details)
  • Socio-professional data (labour market status, level of education, etc.)
  • Data related to professional background
  • Information required for the production of ESF+ indicators

Purposes:

  1. Monitoring the operational functioning of co-financed projects.
  2. Production of indicators and statistics for the European Commission.
  3. Demographic analysis of beneficiary audiences.

The data transmitted to the Ministry are then processed in a pseudonymised or anonymised manner and do not allow a person to be directly identified in statistical reports.

3. Legal Basis

The processing carried out by EIS is based:

  • on your consent (form for service requests or participation in an event/training and voluntary newsletter subscription);
  • on the execution of pre-contractual or contractual measures;
  • on a legal obligation when data are collected in the context of ESF+;
  • on legitimate interest for the management and security of the site.

The processing carried out by the Ministry of Labour in the context of ESF+ is based on the aforementioned European regulations.

4. Recipients of the Data

The data are accessible to:

  • the authorised teams of EIS;
  • to our technical service providers (hosting, maintenance), bound by a confidentiality obligation;
  • to the Ministry of Labour / ESF+ Managing Authority for co-financed actions;
  • where applicable, to the European Commission in pseudonymised or aggregated form.

No transfer outside the European Economic Area is made, except with appropriate safeguards (standard contractual clauses) when certain technical tools require it.

5. Retention Period

Data are retained only for the period necessary for the purpose pursued.

  • Newsletter data: until unsubscription.
  • Technical data: maximum 6 months.
  • Data relating to ESF+ projects: legal retention until 31 December 2041, in accordance with Regulation (EU) 2021/1060 and applicable archiving obligations.

6. Security

We implement appropriate technical and organisational measures to protect your data against:

  • unauthorised access;
  • loss;
  • alteration;
  • unlawful disclosure.

Where possible, data are pseudonymised or anonymised.

7. Vos droits

In accordance with the GDPR, you have the following rights:

  • right of access;
  • right to rectification;
  • right to erasure;
  • right to restriction of processing;
  • right to object;
  • right to data portability.
